Article 1 – Scope of application

The general terms and conditions of sale detailed below apply to all orders placed with Maison Standards for all items and services offered on the Maisonstandards.com website. They are permanently accessible on the Site.

Maison Standards reserves the right to adapt or modify these terms and conditions at any time. The version of the general terms and conditions of sale applicable to any transaction is the one appearing online on the website www.maisonstandards.com at the time of the order. Consequently, placing an order implies full and unreserved acceptance of these terms and conditions.

Subject to any provision contrary to the law, the General Terms and Conditions applicable to the relationship established between Maison Standards and the Customer are those in force on the day the order is validated. They apply to the exclusion of all other conditions. As Maison Standards does not carry out any telephone canvassing, the provisions of the Consumer Code relating to telephone canvassing at home are therefore inapplicable to orders covered by these General Terms and Conditions.

 

Article 2 – Orders and pre-orders

Orders and pre-orders are made exclusively on the Site. Connection and Internet access costs are the responsibility of the Customer.

Orders placed on the Site are subject to compliance with the procedure established by Maison Standards, which is embodied by a series of different steps that the Customer must follow to validate their order. Any order validated by the Customer constitutes a sales contract and unreserved acceptance of all the General Terms and Conditions.

Under the law, the so-called "double click" process when validating the order, combined with the authentication and non-repudiation procedure, as well as the protection of the integrity of messages, constitutes an electronic signature, which has the same value between the parties as a handwritten signature. Unless proven otherwise, the data recorded by MAISON STANDARDS constitutes proof of all transactions between MAISON STANDARDS and its customers.

A confirmation of the order or pre-order validated by the Customer will be sent to him by email prior to the dispatch of the order, and will make the sale final subject to the right to exercise the right of withdrawal. To this end, the Customer formally accepts the use of email for confirmation by Maison Standards of the content of his order. The version of the General Terms and Conditions applicable to a given order may be kept by the Customer by electronic recording or printing on paper.

 

Article 3 – Availability

The products offered for sale are those described on the Site on the day the user consults the site, within the limits of available stocks. Sales are concluded subject to the actual availability of the products.

In the event that an ordered product proves unavailable, for reasons beyond MAISON STANDARDS' control, the Customer will be informed by email. The order will be automatically canceled and refunded.

Maison Standards takes the greatest care in the presentation and description of its products to best satisfy the Customer's information needs. However, it is possible that non-substantial errors may appear on the Site, which the Customer acknowledges and accepts.

In any event, in the event of non-conformity of the product delivered with respect to its description on the Site, the Customer may either exercise his right of withdrawal or implement the conformity guarantee of Maison Standards which will proceed to the reimbursement of the price (in whole or in part) possibly invoiced.

When an item's size is temporarily unavailable, the customer has the option to sign up for an alert that will allow them to receive an email notification informing them when the desired size is back in stock. The email address provided is used by Maison Standards solely for the purpose of this stock alert and is not shared with any third party.

 

Article 4 – Price and payment terms

Maison Standards reserves the right to modify its prices at any time, but products will be invoiced based on the prices in effect at the time the customer confirms the order, subject to availability.

All prices displayed are calculated including value added tax (VAT at the current rate), excluding participation in processing and shipping costs, which are the subject of a separate section at the time of ordering, depending on the characteristics of the order. These costs are brought to the attention of the Customer before the order validation stage.

Product prices are listed in euros, all taxes included, excluding shipping costs. The total price of the order (all taxes and shipping costs included) is shown in the shopping cart. Customs clearance and payment of various duties or taxes are your responsibility.

In the case of a sale outside the euro zone, the total price of the order will be without taxes applicable in France (20% VAT), but the customer will bear the sole responsibility of any taxes that may be applied by their country upon entry. In the event of a return, MAISON STANDARDS will not be able to refund any taxes paid by the customer in their country.

Products are payable in cash on the day the order is actually placed. The products remain the property of MAISON STANDARDS until full payment of the price.

Payment for purchases is made on our PayPlug payment platform, by credit card (Carte Bleue, Mastercard, Visa and American Express), by payment account (PayPal) or by using a Maison Standards credit note or gift card. The card is debited at the time of order validation.

Payment for purchases can also be made by split payment with our partner Oney.

Our partner Oney Bank offers you a financing solution called 3x 4x Oney, which allows you to pay for your purchases from €100 to €3,000 in 3 or 4 installments with your bank card. Conditions: This offer is reserved for individuals (adult individuals) residing in France and holders of a Visa or MasterCard bank card with an expiration date beyond the duration of the chosen financing. Systematic authorization cards, in particular Electron, Maestro, Nickel, etc., as well as e-cards, Indigo and American Express cards are not accepted.

The Customer expressly acknowledges that the communication of his bank card number to MAISON STANDARDS constitutes authorization to debit his account for the amount of the products ordered.

The data recorded and stored by MAISON STANDARDS constitutes proof of the order and all past transactions. The data recorded by CIC constitutes proof of financial transactions.

 

Article 5 – Delivery

The delivery times indicated are in working days. Deliveries are made by La Poste Colissimo services from Monday to Saturday.

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer, a natural person of their choice or a legal entity (delivery to their company). No deliveries will be made to hotels or PO boxes.

Orders are shipped the same day if the order is placed before 12 p.m. subject to product availability, otherwise they will be shipped the next day. In order to meet these deadlines, the Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

Customers can also choose to have their order delivered to one of our stores via click and collect. Delivery times are a minimum of 1 hour during store opening hours. Customers will be notified by email when their package is received at the store. The package will then be made available to them for a period of 30 days.

The times indicated are indicative times, corresponding to the average processing and delivery times. MAISON STANDARDS cannot be held responsible for the consequences due to a delay in delivery not due to its fault.

During periods of commercial operation, the preparation and shipping time may exceptionally be extended by 10 working days.

Delivery times for pre-orders start from the date the product is put on sale on the maisonstandards.com website.

In the event of an abnormally long delivery time or non-receipt of ordered products, the customer can contact customer service within 30 days by email at contact@maisonstandards.com . An investigation will then be opened with La Poste to locate your package. The duration of this investigation can vary from 3 weeks to 1 month, depending on the period. If the package is found, it will be immediately reshipped to the address indicated when ordering. If the package is declared lost by La Poste, the products will be reshipped (while stocks last) or refunded. No refund or return of products can be made before the investigation is closed.

Article 6 – Returns and Exchanges

Pursuant to Article L.121-20 et seq. of the French Consumer Code, the Customer may request a refund for their items within 14 days of receiving their order. Products for which a return slip was created during the 14-day withdrawal period but are deposited at the Post Office outside of this period will be refunded in the form of a credit note valid for 6 months.

The return of the product(s) is handled by MAISON STANDARDS for orders placed online, in Metropolitan France, by Colissimo using the return slip generated on the site (see procedure on the Delivery & Return page). The product(s) must be returned in its original packaging, in its original condition, new, unworn, unwashed, with the security label never detached from the product, accompanied by the return slip printed on the site, in the "my account" section to the following address:

The customer must attach a copy of the invoice or any other element allowing the order to be identified. Any reservations regarding the condition of the products (e.g., open or damaged package) must be notified immediately upon delivery.

If the Customer fails to comply with these conditions, in particular the return conditions, MAISON STANDARDS will not be able to refund the products concerned.
If the purchase was not registered via the maisonstandards.com e-shop, it cannot be subject to refund requests.

Exchanges for a change of size are possible up to the price of the item originally ordered and while stocks last at the time the return is processed. Exchange orders are shipped free of charge by tracked Colissimo to the postal address of your choice (excluding post offices or relay points). If the desired size is unavailable, a refund of the amount of the returned item will be issued.

Return costs are covered by MAISON STANDARDS in Metropolitan France, Belgium, the Netherlands, Luxembourg and Germany via a Colissimo return label generated on the site (see procedure on the Delivery & Returns page) .

Right of Withdrawal

The customer has 14 days from the date of receipt of the order to exercise his right of withdrawal by sending us his request by email ( contact@maisonstandards.com)

Refunds for returned items will be issued after the return has been verified and registered. We undertake to process and refund any return that complies with these conditions within 30 days.

 

Article 7 – Compliance, After-sales service

The photos are provided for illustrative purposes. The Customer is invited to refer to the description of each product to know the precise characteristics. In case of doubt, or to obtain additional information, it is possible to contact customer service by e-mail at contact@maisonstandards.com .

MAISON STANDARDS undertakes to reimburse the Customer for products that appear to be defective, damaged, or that do not correspond to the order. In this case, the Customer must provide a detailed written statement of the situation and return the product(s) within 30 days of receipt.

In any event, the customer benefits from the legal guarantees of conformity and hidden defects, in accordance with the legal provisions in force:

Reminder of Articles L.211-4, L.211-5 and L.211-12 of the Consumer Code, and Articles 1641 and 1648, first paragraph, of the Civil Code:

“Article L.211-4 of the Consumer Code: the seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility.”

“Article L.211-5 of the Consumer Code: To comply with the contract, the goods must:

1° Be suitable for the use usually expected of a similar good and, where applicable:

- correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model;

- present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;

2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

“Article L.211-12: Action resulting from lack of conformity is prescribed after two years from delivery of the goods.”

"Article 1641 of the Civil Code: The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them."

“Article 1648 of the Civil Code, first paragraph: The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.”

Article 8 – Guarantees and liability

MAISON STANDARDS has, for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services, only an obligation of means. Maison Standards cannot be held liable for any inconvenience or damage inherent in the use of the internet network, in particular a service interruption, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and case law.

In the event of the occurrence of a force majeure event, the party concerned must inform the other within fifteen (15) days of the occurrence of this event, by registered letter with acknowledgment of receipt. Expressly considered as cases of force majeure or fortuitous events, in addition to those usually recognized by the jurisprudence of the French courts and tribunals, are total or partial strikes, lockouts, riots, boycotts or other actions of an industrial nature or commercial disputes, civil unrest, insurrection, war, bad weather, epidemic, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes in the forms of marketing, computer breakdown, blockage of telecommunications, including wired or wireless telecommunications networks, and any other case beyond the control of the parties preventing the normal execution of the contractual relationship. All obligations of the parties will be suspended for the duration of the force majeure event, without compensation. If the force majeure event continues for more than three months, the contract concerned may be terminated automatically without compensation for either party.

 

Article 9 - Intellectual and Industrial Property

All illustrations, images, characters, presentation methods, graphics, and characters on the Site are and remain the exclusive property of MAISON STANDARDS or the holders of said rights who have granted MAISON STANDARDS a right of exploitation. Any reproduction, representation, or use of said rights by a Customer will constitute an offense giving rise to legal action.

 

Article 10 – Data Protection, Personal Data

The Customer is informed and accepts that his personal data may be collected on the Site and used by Maison Standards, which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter “General Data Protection Regulation” or “GDPR”).

Maison Standards is committed to protecting and ensuring the security and confidentiality of its Customers' personal data in accordance with the GDPR, in particular by taking all necessary precautions to prevent this data from being distorted, damaged or accessed by unauthorized third parties.

In particular, Customers' personal data may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the GDPR, intervene and contribute directly to the management of Orders and for whom it is absolutely necessary to access the personal data provided by the Customer when creating and using their Account (identity, postal address, telephone number, email address). Subcontractors may only act on the instructions of Maison Standards

Customers' personal data is collected for the following purposes:

  • management of Orders and Customer relations;
  • Customer information relating to offers and commercial information related to the brand;
  • strengthening and improving communication about the Website and the brand by sending, in particular, newsletters and special offers based on the Customer's preferences noted on the Site;
  • propose offers that correspond to preferences identified using browsing data (added to cart, abandoned cart, purchase history);
  • the improvement and personalization of the services offered to Customers; and
  • compliance with legal and regulatory obligations.

The Client's personal data is only kept for the period strictly necessary for the purposes set out above.

In accordance with the GDPR, the Client has the right to access, rectify and oppose personal data concerning him/her (hereinafter the “Data Protection Rights”).

Each request must be signed and accompanied by a photocopy of an identity document bearing the Client's signature and specify the reply address.

The Client may provide Maison Standards with specific instructions in which he or she defines the manner in which he or she intends that the Data Protection Rights and Freedoms be exercised after his or her death in accordance with the GDPR.

Maison Standards may send customers information relating to the brand's products and commercial offers by mail, email, text message, telephone or via all of the web spaces managed by Maison Standards on social networks, subject to prior acceptance.

The customer has the option at any time to oppose these commercial prospecting mailings free of charge, by clicking on the "unsubscribe" link included in each commercial email, by making a request to customer service via an email to contact@maisonstandards.com , by unchecking the newsletter subscription box in their Personal Information on the site or by replying STOP by text message.

 

Article 11 – Applicable law, Disputes

The contract formed by the acceptance of these General Terms and Conditions is subject to French law. The language of this contract is French. In the event of a dispute, the French courts will have sole jurisdiction.

 

Article 12- Mandatory legal information

The confidentiality of correspondence is not guaranteed on the Internet; it is the responsibility of each Internet user to take all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet.

Article 13 – Commercial Offers

- Sponsorship offer:

Each registrant can invite their friends to benefit from a reduction of 10 euros, in the form of a promo code which can be used by the godchild whenever they wish.

The referrer will also be rewarded with a €10 credit per referral when they place their first order. Their credit will be credited to their account, and they will be able to track the progress of their invitations in the "Referrals" tab.

The credits will be available on the godchild's and godfather's account in the form of a promo code, and can be used at any time within the validity period. Discounts are automatically cumulative (in the case of multiple discounts).

The discount coupon allocated to the godchild will be valid for 1 year from the day he receives the invitation from his sponsor.

For the sponsor, their discount coupon is valid for 1 year from the day their godchild places their first order. If they already have a discount coupon, when a new godchild places an order, the validity period of all their discount coupons is again one year. This means they will have 1 year to benefit from the total amount they have.

Article 14 – Credit and e-gift card

Gift cards are valid for one year, and credit notes are valid for three months. Gift cards and credit notes are non-refundable and valid exclusively on maisonstandards.com. In the event of a return, a new credit note for the amount of the item will be issued.
